BOARD OF EQUALIZATION MINUTES
June 23, 2015
A meeting of the Board of Equalization of the County of Cuming, in the State of Nebraska was convened in open and public session at 1:00 p.m. on June 23, 2015, at West Point, Nebraska with all members present.
Notice of the meeting was given in advance thereof by publication on the County Website and in the Wisner News Chronicle, legal newspaper for Cuming County, two of the County’s designated methods for giving notice, a copy of the agenda being attached to these minutes. Notice of this meeting was published as a combined notice with the County Board of Supervisors’ June 23 & 24, 2015 notice. Notice of this meeting was given in advance to the members of the Board of Equalization and a copy of their acknowledgment of receipt of notice and the agenda are attached to these minutes. Availability of the agenda was communicated in the advance notice and in the notice to the County Board of Equalization of this meeting. The Chairman of the Board publicly stated to all in attendance that a current copy of the “Nebraska Open Meetings Act” was posted at the entrance to the meeting room and the pamphlet form of the act is available upon request. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
- MINUTES
A motion was made by Meister and seconded by Mutzenberger to approve the minutes of the last meeting as read. All present voted yea in favor of said motion.
- TAX CORRECTIONS
The following tax corrections were presented to the Board for approval; ID# 000010120 – PP – corrected cost for 2013 & 2014 – deducted $1,047.68 from the tax rolls. A motion was made by Ross and seconded by Ott to accept the corrections as presented. Upon a roll call the vote resulted as follows; Meister, Ross, Sill, Wiechman, Ott, Mutzenberger and Tichota, yeas; nays none; motion carried.
- OVERVALUED, UNDERVALUED OR OMITTED PROPERTY LIST
A list of overvalued, undervalued or omitted property list was presented to the Board for approval. A motion was made by Mutzenberger and seconded by Wiechman to accept the list as presented. Upon a roll call the vote resulted as follows; Meister, Ross, Sill, Wiechman, Ott, Mutzenberger and Tichota, yeas; nays none; motion carried. - 4. PROTEST HEARINGS
#1) Humbug Investments LLC
Legal description: Lot 1, Blk 14 Wisner Original
Assessed Value: $21,650 – Requested Value: $19,750
Reason for protest: removing sheds and property in rough shape
Assessor’s recommendation: reduce valuation to $20,350
A motion was made by Mutzenberger and seconded by Ott to accept the Assessor’s recommendation and change the value to $20,350. Upon a roll call the vote resulted as follows; Wiechman, Mutzenberger, Ross, Ott, Sill, Meister and Tichota, yeas; nays none; motion carried.
#2) Chyanne Krause
Legal description: E1/2 Lot 5 Blk 37 WPC
Assessed Value: $66,505 – Requested Value: $62,500
Reason for protest: neighborhood and square footage don’t warrant the increase in valuation
Assessor’s recommendation: $63,490
A motion was made by Sill and seconded by Mutzenberger to accept the Assessor’s recommendation and change the value to $63,490. Upon a roll call the vote resulted as follows; Wiechman, Mutzenberger, Ross, Ott, Sill, Meister and Tichota, yeas; nays none; motion carried.
#3) Jena Brazada-Toy
Legal description: Lot 54, Valley View Add, Wisner City
Assessed Value: $129,090 – Requested Value: $105,560
Reason for protest: property has been listed for $134,900 and reduced to $124,000 and currently there is a pending sale for less than the current valuation. Property needs a considerable amount of work to sell for current valuation.
Assessor’s recommendation: $110,975
A motion was made by Meister and seconded by Sill to accept the Assessor’s recommendation and change the value to $110,975. Upon a roll call the vote resulted as follows; Wiechman, Mutzenberger, Ross, Ott, Sill, Meister and Tichota, yeas; nays none; motion carried.
#5. VEHICLE EXEMPTION
A vehicle exemption application to exempt motor vehicle taxes was submitted from Franciscan Care Services for a 2015 Ford Focus and a 2015 Chevrolet Sonic. A motion was made by Sill and seconded by Wiechman to accept the application as presented. Upon a roll call the vote resulted as follows; Wiechman, Mutzenberger, Ross, Ott, Sill, Meister and Tichota, yeas; nays none; motion carried.
- ADJOURN AS A BOARD OF EQUALIZATION
At 2:15 p.m., a motion was made by Sill and seconded by Wiechman to adjourn as a Board of Equalization and reconvene as a Board of Supervisors. All present voted yea in favor of said motion.
The Board of Equalization agreed to reconvene July 21st and 22nd, 2015, at 9:00 a.m. for protest hearings. The agenda kept current in the office of the County Clerk and on the County Website (www.cumingco.com).
